Methods of expertise, publications of the expert
Expertise is made applying to the pragmatical methods of legal thinking.Expert Volodymyr Desyatnyk is sure that:
- well-known words of the great American judge O.Holmes say that, “In the basement of the law not the logic but the experience” (The Common Law, 1881) are also applicable to the of continental Europe, including Ukrainian lawyers;
- using of abstract intellectually intuitive methods of legal thinking, which are dominating in the Ukrainian legal education and science, in the solving of practical private jural problems is ineffective and even harmful.
The differences between pragmatic and intellectual methods of legal thinking are briefly stated by V.Desyatnyk in one of his conceptual works.
